Bounce Back Generation, Inc., a California nonprofit public benefit corporation (the “Company”, “we”, “our” or “us”) respects your privacy and is committed to protecting it through our compliance with this policy. We refer to any person accessing or using our website (as defined below) as “you”, “your”, or the “User”.

This privacy policy (the “Policy”) describes the types of information we may collect from you, either directly through our website at https://www.bouncebackgeneration.org/ (our “Website”), or on or through our service provider platform, which enables the functionality of our Website. The Policy also describes our practices for collecting, using, maintaining, protecting, and disclosing that information.

This Policy applies to information we collect:

2. Children Under the Age of 13; COPPA (Children Online Privacy Protection Act)

Our Website is not intended for children under thirteen (13) years of age. No one under the age of 13 may provide any personal information to, or on, the Website. We strive to provide you with choices regarding the personal information you provide to us. The following mechanisms should help to provide you with control over your information:

8. California Users

California law permits Users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for their direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those third parties. We do not share personal information with third parties for their own direct marketing purposes without your prior consent. Accordingly, you can prevent disclosure of your personal information to third parties for their direct marketing purposes by withholding consent.

Please be aware that not all information sharing is covered by California’s “Shine the Light” requirements, and only information on covered sharing will be included in our response.

Further, the California Online Privacy Protection Act (“CalOPPA”) requires commercial websites and online services to post a privacy policy. The law’s reach stretches well beyond California to require any person or company in the United States (and conceivably the world) that operates websites collecting personally identifiable information from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals or companies with whom it is being shared.

We comply with CalOPPA and agree to the following:

  • There is a link on our home page to our Privacy Policy.
  • Our Privacy Policy link includes the word “Privacy” and is easily found on our Website.

Finally, commencing in January 2024 subject to applicability to this Site, in accordance with AB-2273 The California Age-Appropriate Design Code Act, we will not sell the personal information of our users, regardless of age, be it in the form of contact information, geolocation information, or otherwise. Further, we conduct a Data Protection Impact Assessment prior to launching any new online service, product and/or features accessible to the public on our Site, which we will make available to the Attorney General upon written request within 5 business day.

9. Data Security

Be advised that all payment transactions through the Website are encrypted using SSL technology. We use Powr (which, to our knowledge, is fully PCI-compliant) as a payment gateway to facilitate donations and other online transactions.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

10. Notice to Users from the European Economic Area (“EEA”)

If you are visiting and using the Services from the European Economic Area (“EEA”), please be aware that you are sending information (including personal data) to the United States where our partner platform’s servers are located. Our staff operating outside the EEA may process this information. The information may then be transferred within the United States or back out of the United States to other countries outside of your country of residence, depending on the type of information and how we store it. 11. CAN-SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

We collect your email address in order to:

  • Send information, respond to inquiries, and/or other requests or questions.
  • Process contributions.
  • Send you additional information about the Company and/or our clients, other topics which may be of interest to you, or changes to our privacy policy.

To be in accordance with CAN-SPAM, we agree to the following:

12. Fair Information Practices

  • The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information. There are five (5) core principles of Fair Information Practice: (i) consumers should be provided notice of whom the information is going to and what it will be used for; (ii) choices should be offered and consent required; (iii) consumers should be able to access and alter data; (iv) data should be accurate and secure; and (v) mechanisms in place for enforcement and redress are necessary.
